The parents of a child who was allegedly raped by her biological father have filed a federal lawsuit against public officials for refusing to prosecute the crime, according to the Times Record of Fort Smith, Arkansas.

The lawsuit names former prosecutor (now Circuit Court Judge) Stephen Tabor, Chief Deputy Prosecuting Attorney Daniel Shue, the County of Sebastian, Arkansas and the alleged perpetrator. The suit claims that "Tabor and Shue as prosecutors and individuals had a policy against prosecuting sexual assault cases that involve incest," reports the paper, "and that the county dictated and oversaw that policy." The suit was filed last month in U.S. District Court, Western District of Arkansas. When asked about the matter, Judge Tabor said he was proud of his and Mr. Shue's records prosecuting child sexual abuse and pointed to a recent award for "outstanding service on a [child advocacy] task force. "As you know, we each received a plaque."
