From the Associated Press (6/4/08)
"A former state trooper convicted of possessing child pornography has dropped his appeal in return for a promise by prosecutors not to pursue new charges stemming from his relationship with the 6-year-old daughter of a family friend.

Brian Murphy, 34, of Boonsboro was given three years of supervised probation and fined $2,500 in February after he was convicted in Washington County District Court of five counts of possessing child porn....

The convictions were for images that had been downloaded from the Internet onto Murphy's computer.

Murphy withdrew his appeal to circuit court in return for prosecutors' agreement not to file child-abuse charges stemming from evidence that he removed the girl's shirt, put her in handcuffs and photographed her.

Deputy State's Attorney Joseph Michael said such charges would have been difficult to prove."
